Pursuant to delegate decree no. 113 dated 4 August, 2008, on 30 September 2008, all the provisions became effective of the “Regulation for the enforcement of law no. 148 dated 28 October 2005 for the creation of the Roll of qualified entities and Register of qualified companies”.

Among other things, the aforementioned regulation envisages the creation of a register of companies qualified to install, transform, extend and service the plants indicated in art. 1 of Law no. 148/2005. 

WHO MUST REGISTER?

Registration is mandatory for all private or public companies with registered offices in the Republic of San Marino and which operate in the sectors falling within the scope of enforcement of Law no. 148 dated 28 October 2005.  

WHY REGISTER?

Company registration is mandatory because otherwise the workmanlike compliance statement which has to be issued at the end of each installation and/or maintenance and/or extension and/or transformation job would be ineffective, requiring as it does an attached certificate of acknowledgement of technical-professional requirements indicating the sphere of application in which the company may operate. Such certificate is only issued by the San Marino Chamber of Commerce if the company for which the head of the Technical Department works is registered, and this because, on the certificate itself is indicated not only the registration number of such person in the relevant Roll, but also the registration number of the company in the Register. 

HOW TO REGISTER

To register the company, the legal representative must go in person to the Chamber of Commerce and present certificates indicating the performance of activities in the sectors for which qualification is required. The legal representative must also indicate the names of the technical managers, who therefore must already have been registered in the Roll of qualified entities. To proceed to register the technician, he/she too must go in person to the Chamber of Commerce and file an application for registration in the Roll of qualified entities, in accordance with the provisions of articles 4 and 6 of the aforementioned delegate decree no. 113 dated 4 August 2008.Finally, as required by the law, the client or owner must assign the installation, transformation, extension and servicing jobs to qualified companies.
